Since its inception in 1996, the Health Insurance Portability Accountability Act (HIPAA) has caused many patients to worry about the protection of their medical records. HIPAA is administered by the US Department of Health and Human Services with the intention of protecting medical records and the personal information that is associated with those records. Policies, standards, and the manner in which patient information is shared are protected under HIPAA. - Understanding the Security Rule
The Security Rule provides security features under HIPAA. It is a series of technical, administrative, and physical security procedures that are devised to protect patients. In short the Security Rule assures the integrity, confidentiality, and availability of e-PHI (electronic protected health information). The US Department of Health and Human Services, and the Office of Civil Rights are responsible for enforcing the Security Rule and resolving any breaches of the rule.
- Filing a Complaint
If you feel as if your medical rights have been breached and information has been wrongfully shared, then you can file a complaint with the Office of Civil Rights. Once a complaint has been filed, it will be investigated, and a final report will be issued. The Office of Civil Rights is determined to protect the rights of every patient, as such, anyone can file a complaint.
- Protecting your Personal Information
One of the easiest things that you can do to protect your personal information and medical history is to read all forms completely. All too often we are in a rush at the doctor’s office, and so we sign without completely reading the papers in front of us. Take the time to read the forms; doing so will ensure that you know all of your rights.
